Bird Barrier America, Inc. uses the finest materials available to insure long lasting protection. No guarantees are stated as to the effectiveness of any Bird Barrier product.

Bird Barrier’s warranty covers the following products for the following terms and conditions.

StealthNet: Five years materials, workmanship and ultraviolet degradation limited warranty*
Bird-Flight® Spikes: Five years against debilitating corrosion and ultraviolet degradation
Bird Coil and related hardware: Five years against debilitating corrosion
Birdwire and related hardware: Five years against debilitating corrosion and ultraviolet degradation
Bird-Shock Tracks: Five years against debilitating corrosion and ultraviolet degradation
Bird-Shock Charger Units: Two years functionality if installed according to owners manual
Daddi Long Legs: Five years against debilitating corrosion and ultraviolet degradation

Replacement of any of the items listed above is at the discretion of Bird Barrier America, Inc.
THESE WARRANTIES CONSTITUTE ALL OF THE WARRANTIES WITH RESPECT TO THE SALE OF PRODUCTS INDICATED. BIRD BARRIER AMERICA, INC., EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND BIRD BARRIER AMERICA, INC., NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY LIABILITY IN CONNECTION WITH THE SALE OF THESE PRODUCTS. IN NO EVENT WILL BIRD BARRIER AMERICA, INC. BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE WHETHER OR NOT FORESEEABLE.
* Details on Limited Warranty on StealthNet:
StealthNet is warranted by Bird Barrier America, Inc., on a repair or replacement basis only, at its option, for the period of 5 years after original purchase from Bird Barrier America, Inc., by an authorized distributor, or installation date by installer against any defects in materials and workmanship. All warranty replacements shall be free of cost during the warranty period. This warranty does not include damage caused by improper installation, natural disasters, abuse, misuse, negligence, modification, accident or improper handling. Upon presentation of a representative sample of the affected product along with proof of purchase Bird Barrier America, Inc. will either repair, replace or provide a comparable new product. In some cases the repairs shall be made to the netting while it is still installed; therefore please do not remove the netting from the treated area without written instructions from Bird Barrier America, Inc.
Installation of products in a different manner than prescribed in our specifications automatically voids all warranties.
All claims must be submitted in writing and must contain a copy of the original invoice from Bird Barrier America, Inc. or an authorized distributor. Please direct all problems or claims in writing to:

A Bird Barrier Certified Installer will treat the Customer’s structure as specified in the statement of work section of this proposal. Such treatment is intended to drive the targeted pest bird species from the treated areas of the structure without destroying the bird(s).
The treatment may contain one or more of the following products, each with their own warranties.
 StealthNet® - A net and hardware system that serves to exclude birds by providing a physical barrier to entry. Warranty period: Materials- Five (5) years. Installation- One (1) year from the initial Treatment date.
 Bird-Flite - Stainless Steel Spikes with blunt tips arranged in a strip is permanently attached to bird roosting sites. Warranty period: Materials- Five (5) years. Installation- One (1) year from the initial Treatment date.
 Birdwire® - A series of spring tensioned wires installed to repel pigeons and small gulls. Warranty period: Materials- Five (5) years. Installation- One (1) year from the initial Treatment date.
 Bird-Coil® - A Coil of Stainless Steel wire is installed on bird roosting sites to deter pigeons and gulls from landing there. Warranty period: Materials- Five (5) years. Installation- One (1) year from the initial Treatment date.
 Bird-Shock - A strip of parallel conductive strips periodically charged with high voltage, low amperage electrical current installed to repel all types of birds. Warranty period: Track Materials- Five (5) years. Charger Unit(s)- Two (2) years. Installation- One (1) year from the initial Treatment date.
 Daddi Long Legs - A circular series of Stainless Steel wires that deter pigeons and gulls from landing. Warranty period: Materials- Five (5) years. Installation- One (1) year from the initial Treatment date.
LIMITED WARRANTY: The Certified Installer Warranties that all treated areas will be free from the roosting of the pest bird species identified above for the duration of the specified Installation Warranty period. In the event that during the Installation Warranty period the target pest bird roosts in the treated areas, Certified Installer will retreat the affected area(s) at no charge to the Customer. If the target pest bird roosts in the treated areas after the Installation Warranty period and during the Materials Warranty the Certified Installer will inform the Customer of the Installation costs to retreat the affected area(s).
Certified Installer’s Warranty will terminated if the treated portion of the structure of the repelling agent and/or equipment are disrupted, modified, altered or otherwise changed due to human interference or weather so as to render it ineffective.
CUSTOMER’S OBLIGATION TO MAINTAIN WARRANTY: Customer agrees not to disrupt, modify, alter or otherwise change the treated portion of the structure or the repelling agent and/or equipment. In the event the structure is disrupted, modified, altered or otherwise changed the Warranty shall be void.
CANCELLATION: CUSTOMER MAY CANCEL THIS AGREEMENT AT ANY TIME TO MIDNIGHT OF THE SECOND BUSINESS DAY AFTER THE AGREEMENT DATE OF THIS DOCUMENT.
ARBITRATION: IN THE EVENT OF ANY DISPUTE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES PERFORMED UNDER THIS AGREEMENT OR TORT BASED CLAIMS FOR PERSONAL OR BODILY INJURY OR DAMAGE TO REAL OR PERSONAL PROPERTY, THE PARTIES FIRST AGREE TO PARTICIPATE IN AT LEAST FOUR (4) HOURS OF MEDIATION IN ACCORDANCE WITH THE COMMERCIAL MEDIATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION, BEFORE HAVING RECOURSE TO ARBITRATION. IF THE MEDIATION PROCEDURE PROVIDED FOR HEREIN DOES NOT RESOLVE ANY SUCH DISPUTE, THE PARTIES FIRST AGREE THAT ALL DISPUTES BETWEEN THE PARTIES SHALL BE FINALLY RESOLVED BY ARBITRATION ADMINISTERED UNDER THE COMMERCIAL OBLIGATIONS AND THE CONDUCT OF ANY ARBITRATION PROCEEDING SHALL BE CONTROLLED BY THE FEDERAL ARBITRATION ACT. THE ARBITRATOR SHALL GIVE EFFECT TO ANY AND ALL WAIVERS, RELEASES, DISCLAIMERS, LIMITATIONS AND OTHER TERMS AND CONDITIONS OF THIS AGREEMENT. THE ARBITRATOR SHALL CONSIDER THE LEGAL DEFENSES RAISED IN THE ARBITRATION, AND THE DECISION OF THE ARBITRATOR SHALL BE FINAL, BINDING, NON-APPEAL ABLE AND MAY BE ENTERED AND ENFORCED IN ANY COURT HAVING JURISDICTION IN ACCORDANCE WITH THE FEDERAL ARBITRATION ACT.
LIMITATION OF LIABILITY: Customer acknowledges that Certified Installer is performing a service and waives any claims for personal or property damages related to the service Certified Installer performs. Customer agrees that Certified Installer shall not be responsible for any damage to the premises while treating the structure, including any damage to shrubs, trees or plants. Customer agrees that under no circumstances shall Certified Installer be liable for any amount greater than the amount paid by the Customer to Certified Installer for the service to be performed.
AGREEMENT: This Agreement and the attached diagram, if any, shall be the entire Agreement between Customer and Certified Installer. The terms of the Warranty stated above may not be amended or altered unless a written change is approved and signed by a Corporate Officer of Certified Installer. If any portion of this Agreement is found to be invalid, it shall not affect the validity of any other part of this Agreement. The parties do not intend and this Agreement shall not be construed to inure to the benefit of any third party beneficiaries.
FORCE MAJEURE (Circumstances beyond Certified Installer’s control): Certified Installer’s obligations under this agreement shall be cancelled if Certified Installer can not perform its responsibilities because of a substantial change in circumstances including but not limited to acts of war, strikes, unavailability of materials, or other supplies from ordinary sources and Acts of God, including, earthquakes, storms, fires, floods, or if a natural occurrence, such as storms, floods, fires substantially alters or destroys the effectiveness of Certified Installer’s treatment.
TERMINATION: Certified Installer may terminate this Agreement, including the Warranty, if Customer does not meet its payment obligations or customer obligations, or in the event of a change in state or federal law that substantially affect Certified Installer’s obligations under Agreement.
